These Terms of Service apply when you use baroona.com.au, create an account or place an order with Baroona Produce & Pet Supplies (“Baroona”, “we”, “us” or “our”).

By using the website or placing an order, you agree to these terms.

Nothing in these terms limits any rights or remedies that cannot lawfully be excluded, including your rights under the Australian Consumer Law.

Website use and customer accounts

You must provide accurate and current information when creating an account, joining Baroona Local or placing an order.

You are responsible for keeping your account details and password secure. Please contact us if you believe your account has been accessed without permission.

If you are under 18, you should use the website and place orders with the involvement of a parent or guardian.

We may restrict or suspend an account where reasonably necessary to protect customers, prevent fraud, comply with law or respond to serious misuse of the website.

Baroona Local membership

Baroona Local is our free customer-account membership.

It may provide access to:

• Weekly Pre-order products and pricing

• Order-in products

• Order history and account features

• Easier repeat ordering

• Optional ordering reminders

• Relevant stock and local store updates

Baroona Local does not require an annual membership fee.

Paid Baroona Mates memberships and local delivery are not available at website launch. They may be introduced later under separately published terms and conditions.

Product information

We take reasonable care when preparing product descriptions, images, prices and availability information.

However:

• Product packaging may change

• Manufacturers may change ingredients, formulations or specifications

• Images may be illustrative

• Colours and appearance may vary between devices

• Supplier information may change

• Stock may sell through before website information is updated

Please read the current product label, instructions and manufacturer information before using a product.

This is particularly important for animal feed, pet food, animal health products, chemicals, pest-control products and other safety-sensitive items.

General product information

Product descriptions and information on our website are provided for general shopping and product-identification purposes.

They are not veterinary, medical, agricultural, chemical or other professional advice.

Customers are responsible for selecting and using products appropriately and following the current manufacturer’s label, directions, warnings and storage requirements.

Contact a veterinarian, agronomist, manufacturer or other appropriate professional where specific advice is required.

Placing an order

Placing an order is an offer to purchase the selected products.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that:

• We have accepted the order

• Every item is available

• Payment has been finally captured

• The order is ready for collection

• A particular collection date is guaranteed

We may contact you to:

• Confirm product availability

• Discuss a supplier delay

• Correct an obvious error

• Confirm a product, size or quantity

• Discuss a proposed substitution

• Remove an unavailable item

• Decline or cancel an order before acceptance

We will not make a material substitution without contacting you.

Product availability types

Products may be offered under different availability arrangements.

Everyday

Everyday products are normally kept on our shelves. Stock can occasionally sell through before the website is updated.

Pre-order

Pre-orders must be placed by Sunday at 6:00pm for expected Tuesday arrival into store.

Tuesday arrival is subject to supplier availability and transport into store. It is an estimate and cannot be guaranteed.

Order-in

Order-in products are not normally kept on our shelves. We request them through our supplier order and confirm when they are ready.

Special Order

Special Order products have varying availability and lead times. We will confirm availability and the expected collection date separately.

Prices

Prices are shown in Australian dollars and include GST where applicable.

Different prices may apply to Everyday shelf stock, Pre-order products, Order-in products or Special Orders.

The price displayed for the purchasing option selected at checkout applies to that order, subject to correction of an obvious error before we accept the order.

If an obvious pricing or product-information error is identified, we will contact you before accepting or completing the affected part of the order.

Payment authorisation and capture

Payment may be authorised when an order is placed before stock has been finally confirmed.

Where available through our payment system, we may:

• Capture payment only for products we can supply

• Release an unused payment authorisation

• Remove or cancel an unavailable item

• Issue a full or partial refund

• Contact you before making a material change

The timing of an authorisation release or refund appearing in your account may depend on your bank or payment provider.

Collection only at launch

Online orders are collected from Baroona Produce & Pet Supplies at 2434 Warburton Highway, Yarra Junction VIC 3797.

We do not offer postage, courier shipping or local delivery at website launch.

Please wait until we confirm that your order is ready before travelling to collect it.

Our current opening hours are:

Tuesday–Friday: 9:00am–5:00pm
Saturday: 9:00am–1:00pm
Closed Sunday and Monday

Supplier delays and unavailable products

Supplier availability, transport into store and unexpected stock problems may affect an order.

If an item is delayed or unavailable, we will contact you where reasonably necessary.

If we cannot supply an item, any applicable payment authorisation will be released or the amount paid for that item will be refunded.

We are not responsible for delays outside our reasonable control, but we will communicate with you and provide any remedy required by law.

Order cancellations

Please contact us promptly if you need to cancel an order.

Cancellation may not be possible after we have committed a Pre-order, Order-in or Special Order product to a supplier or incurred a non-refundable supplier cost.

This does not affect your rights where a product fails to meet a consumer guarantee.

Returns and refunds

Returns, refunds, replacements and consumer remedies are governed by our Refund Policy and the Australian Consumer Law.

Our Refund Policy forms part of these terms.

Marketing and communications

We may send service communications reasonably required to manage your account, membership or order.

Marketing email or SMS communications will be sent where you have consented or where otherwise permitted by law.

You can unsubscribe from optional marketing communications using the unsubscribe option provided or by contacting us.

Privacy

Our handling of personal information is described in our Privacy Policy.

Our website is powered by Shopify. Shopify and other service providers may also process information under their own privacy policies and terms.

Acceptable use

You must not:

• Use the website unlawfully or fraudulently

• Attempt to gain unauthorised access to an account or system

• Interfere with website, checkout or payment operation

• Upload malicious software or harmful content

• Use automated systems to disrupt or overload the website

• Provide false or misleading account or payment information

• Use website content for unauthorised commercial purposes

Third-party services and links

The website is powered by Shopify and may use third-party payment, communication, analytics, security and other services.

Third-party websites and services have their own terms and privacy practices.

Links to manufacturers, suppliers or other websites are provided for convenience and information. Baroona does not control those websites and is not responsible for their separate content or practices.

Intellectual property

Unless otherwise stated, website content created for Baroona—including our branding, written content, graphics and layout—is owned by or licensed to Baroona.

You may use the website for personal shopping purposes.

You must not reproduce, distribute, modify or commercially exploit Baroona content without permission, except where permitted by law.

Website availability

We aim to keep the website accurate, secure and available.

We do not guarantee that the website will always operate without interruption, delay or error. We may temporarily suspend or change parts of the website for maintenance, security or operational reasons.

Changes to these terms

We may update these terms when our website, services, membership arrangements or legal obligations change.

Updated terms apply from the date they are published. Changes do not remove rights already accrued under an accepted order or applicable law.

Liability

To the maximum extent permitted by law, Baroona is not liable for indirect or consequential loss caused by website interruption, unauthorised misuse or circumstances outside our reasonable control.

Nothing in these terms excludes or limits liability where it cannot lawfully be excluded or limited.

Governing law

These terms are governed by the laws of Victoria, Australia.

Courts and tribunals with jurisdiction in Victoria may hear disputes, subject to any rights you have under applicable consumer law.
